These terms describe the use of Brittain Software websites, hospitality Voice-AI services, and SMS communications.

Agreement To These Terms

By using Brittain Software websites, Voice-AI services, call systems, SMS communications, or related hospitality technology services, you agree to these Terms and Conditions. If you are using the services on behalf of a business, you represent that you are authorized to do so.

About Brittain Software Services

Brittain Software provides Voice-AI, reservation support, call analytics, quality review, and related systems for hospitality businesses, including restaurants, hotels, and guest-service teams. The services may answer caller questions, capture reservation details, route calls, send requested SMS messages, and create operational analytics for hospitality teams.

SMS Program Description

The Brittain Software Hospitality SMS Program sends requested hospitality-related messages for supported restaurant and hotel workflows. Messages may include reservation confirmations or requests, booking or checkout links, property information, restaurant information, addresses, and support phone numbers related to a recipient's phone call or request.

SMS Consent

You may opt in to receive SMS messages by providing verbal consent during an inbound phone call or by another consent method presented by Brittain Software or its supported hospitality clients. Consent is not a condition of purchase.

When verbal opt-in is used, the caller is told what type of text will be sent, that message frequency varies, that message and data rates may apply, and that they can reply HELP for help. They can reply STOP to opt out. SMS messages are sent only after the caller gives affirmative consent.

Message Frequency And Charges

Message frequency varies based on the recipient's request and interaction with the service, usually 1-2 messages per reservation or information request. Message and data rates may apply. Message frequency may vary if a recipient makes multiple requests or has multiple reservation or guest-service interactions.

Opt-Out And Help Instructions

You can opt out of SMS messages at any time by replying STOP. After you send STOP, you may receive a confirmation that you have been unsubscribed, and no further SMS messages will be sent unless you opt in again.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery depends on carrier networks, recipient device settings, and other conditions outside Brittain Software's control.

Privacy

Our handling of information, including SMS consent records and mobile numbers, is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data, consent records, and mobile numbers will not be sold, rented, or shared with third parties for their marketing.

Acceptable Use

You agree not to misuse the services, attempt unauthorized access, interfere with service operation, submit unlawful content, or use the services in a way that violates applicable law, carrier rules, or third-party rights.

No Emergency Use

Brittain Software services are not emergency services. Do not use the websites, Voice-AI systems, or SMS channels for emergencies. For emergencies, call 911 or the appropriate emergency service.

No Guaranteed Availability

We work to keep services available and accurate, but we do not guarantee uninterrupted operation, error-free content, message delivery, reservation availability, pricing, or final booking confirmation unless confirmed by the applicable hospitality business or reservation system.

Third-Party Services

The services may interact with third-party platforms such as telecommunications providers, reservation systems, cloud hosting providers, analytics services, and hospitality client systems. Third-party services may have their own terms and policies.

Changes To These Terms

We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the services after updates means you accept the updated terms.
